ISSUES AROUND OWNERSHIP OF A.I GENERATED WORKS AND WEATHER AI CAN BE CONSIDERED AN AUTHOR UNDER COPYRIGHT LAW

Image
INTRODUCTION The rapid development of artificial intelligence (AI) has transformed numerous sectors, including creative industries such as art, literature, and music. AI-generated works, whether created by algorithms or machine learning models, are now an integral part of modern creativity. However, this evolution has raised critical questions about the ownership of these AI-generated creations and whether AI can be considered an author under current copyright law. Traditional copyright frameworks, which are designed to protect the intellectual property of human creators, face challenges when applied to works produced by machines. This research seeks to explore the legal and ethical issues surrounding the ownership of AI generated works. It aims to address the fundamental question of whether AI, as a non-human entity, can be recognized as an author and if not, who holds the rights to the creations it produces. The ambiguity surrounding this issue has significant implications for in...

PROFESSIONAL ETHICS OF ADVOCATES: THE CORNERSTONE OF JUSTICE

Image
PROLOGUE In every democratic society, the legal profession occupies a central role in protecting rights, upholding the rule of law, and ensuring justice. However, this role is only meaningful when advocates conduct themselves with integrity and responsibility. Professional ethics for advocates are not mere formalities; they are the very foundation upon which public trust in the legal system rests. The Ethical Framework In India, the Advocates Act, 1961 and the Bar Council of India (BCI) Rules provide a clear code of conduct for advocates. These include duties towards clients, courts, opponents, and society at large. At the heart of these duties lies a simple truth: an advocate is not just a representative of their client but also an officer of the court. KEY ETHICAL DUTIES Duty to the Court   Advocates must maintain respect for the judiciary, present cases fairly, and never mislead the court. The Supreme Court has often emphasized that an advocate’s loyalty to the court takes prec...

ALGORITHMIC BIAS AND DISCRIMINATION

Image
INTRODUCTION Algorithmic systems increasingly influence decisions in employment, finance, healthcare, criminal justice, and beyond. These systems were designed to capture the knowledge and thought processes of legal experts and provide automated decision-making tools. While they promise efficiency and impartiality, their reliance on historical data and the biases embedded within these datasets often result in discriminatory outcomes. For instance, facial recognition technology has been criticized for higher error rates when identifying individuals of certain ethnic groups, and predictive policing algorithms may disproportionately target minority communities. The rapid integration of artificial intelligence (AI) and machine learning into decision-making processes has revolutionized industries. However, these systems are not immune to bias and discrimination, which can have significant social and legal implications. The integration of Artificial Intelligence into the legal system has...

DNA PROFILING AND THE CHALLENGES TO FORENSIC SCIENCE

Image
INTRODUCTION DNA Profiling is a technique that can be used to distinguish any individual from others, except in rare cases of a monozygotic twins. In Forensic Science, DNA profiling is considered as one of the best working tools in crime scenes. It is used to distinguish two individuals who might have been at a particular place and their connection to the crime by matching the DNA found at the crime scene with the DNA of the suspect, in addition to its importance, it can also be used to identify the victims in the event of mass disasters such as airplane crash, bomb explosion etc. Besides, DNA profiling, a development that started back in 1985 at the university of Leicester in England, courtesy of the discovery made by Alec Jeffreys who is widely known as the father of DNA fingerprinting, has become the SI Unit for detecting suspects in a particular criminal case, discharging the wrongly accused and settling disputes with regards to parentage of a child. This technique is...
